Terms of Service & Creator Platform Agreement

1. Acceptance of Terms

By accessing or using Orgemy (“Platform”, “Service”), you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a company, creator studio, or agency, you represent that you possess the authority to bind such entity to these Terms.

2. Account Responsibility & Tenancy

You must maintain the security of your workspace credentials and API keys. You are fully responsible for all activities, automations, messages, and external API requests executed under your workspace credentials.

3. Creator Intellectual Property & Audience Ownership

Your Content and Audience: You retain complete, unencumbered ownership of all creator content, brand assets, customer contact lists, and digital products uploaded to or managed via Orgemy. Orgemy claims zero ownership or intellectual property rights over your contacts.

4. Brand Collaborations & Sponsorship Escrow

When utilizing Orgemy Deals and collaboration portals:

• Creators agree to deliver agreed-upon social media deliverables, videos, or posts according to contract milestones.
• Brand sponsors agree to fund agreed compensation into escrow or release funds upon milestone approval.
• Brand reviews must be 100% authentic and reflect real completed transactions. Astroturfing, fake reviews, or retaliatory review manipulation results in immediate trust badge revocation.

5. Acceptable Use Policy & Anti-Spam Enforcements

Orgemy maintains zero tolerance for abusive messaging. You agree not to:

• Send unsolicited commercial email (spam) or messages to recipients without verifiable consent.
• Circumvent rate limits, velocity thresholds, or feature flag policies.
• Attempt SQL injection, Cross-Site Scripting (XSS), or unauthorized cross-workspace tenant access.
• Deploy autonomous AI agents to harass, deceive, or defraud individuals.

6. Subscription Billing & Fair Cancellation

Paid plans (Pro Creator, Studio & Agency) are billed in advance on a recurring monthly or annual basis. You may cancel your subscription at any time via workspace billing settings without penalty or dark patterns.
